Life Insurance Attorney and Accidental Death Insurance Lawyer
A Colorado statute, Section 10-3-1116(1) in the Colorado Revised Statutes, provides that an insurance policy beneficiary “whose claim for payment of benefits has been unreasonably delayed or denied may bring an action in a district court to recover reasonable attorney fees and court costs and two times the covered benefit.” An insurer’s delay or denial was unreasonable if the insurer delayed or denied authorizing payment of a covered benefit without a reasonable basis for that action.
Common reasons given by insurance companies not to pay death benefits include untimely payment of premiums, misrepresentations on an insurance application, or undisclosed health problems. Accidental death benefits are denied by insurance companies who claim death was not accidental. So, for example, they claim an accidental death caused by prescription medications was really a complication of illness and not an accident. This is the business of life insurance – take premiums but find reasons not to pay.
