Attorney Brian K. Stutheit is a lawyer with over thirty- five years experience. He is AV Preeminent* rated under Martindale-Hubbell’s peer review system. This is the best rating possible based on confidential surveys of other lawyers and judges. It is the resource lawyers use to evaluate other lawyers.

Mr. Stutheit knows the law, knows the practice of law, cares about doing high-quality work, is resourceful, is responsive and strives to provide real value for the fees he charges his clients. He won’t recommend work he doesn’t believe will benefit the client. He does not fear or avoid hard work, does not fear or avoid conflict (yet does not seek it out), does not fear or capitulate to other lawyers, and does not fear his own clients, because he believes his duty is to be candid with clients.

He was listed by Denver Magazine and The American Lawyer as one of Colorado’s best construction lawyers. A significant real estate non-disclosure case of his was reported in the Colorado Springs Gazette newspaper. He has been interviewed on Colorado Public Radio and Denver television stations about unemployment law, and he was interviewed in The Atlantic magazine about his winning pregnancy discrimination case.  He is a contributing author to West’s Colorado Practice Series, Civil Procedure Forms And Commentary.

Career Overview

The firm and Mr. Stutheit handle mechanics lien disputes (contractor liens), drafting and review of construction, remodeling and repair contracts, and real estate fraud non-disclosure claims.  We also practice certain areas of residential real estate law, including realtor malpractice, trespass and title problems.

Mr. Stutheit’s other areas of practice are: estate planning (wills, powers of attorney, advance directives, prenuptial and post-nuptial agreements), probate estate administration, will contests and probate disputes, and unemployment law.

“I retained Brian to help me with an unemployment claim that was rejected because I was fired by a very large company. I felt very strongly that I should not have been fired and Brian provided me plenty of time to communicate my perspective, thoroughly describe the appeals process and was present to help with the actual Appeal hearing. Him being at the appeal was very important to me while I was going through stressful and trying times. The employer had two lawyers and two witnesses to oppose me. I won. All of this was for a fixed cost. I would highly recommend him to anyone in the same situation.”

Before founding his own firm in 1998, Brian Stutheit was a partner at Montgomery Little & Soran in Greenwood Village, Colorado. This was a law firm of over 25 attorneys. Mr. Stutheit’s practice emphasized probate litigation and defense of construction defect and negligence cases against professional engineers and contractors.
